1. Agreement to These Terms
These Terms of Service ("Terms") govern access to and use of websites, billing services, control panels, hosting, support, and related products provided by Paradise Hosting ("Paradise Hosting," "we," "us," or "our"), a sole proprietorship operating from New York, United States.
By creating an account, placing an order, paying an invoice, or using a service, you agree to these Terms, our Acceptable Use Policy, Privacy Policy, and Refund Policy. If you do not agree, do not use the services.
2. Eligibility and Minors
You must be at least 13 years old to use the services. Customers aged 13 through 17 may use the services only with permission and supervision from a parent or legal guardian. The parent or guardian is responsible for the account, payments, hosted content, and compliance with these Terms.
Children under 13 may not create accounts or use the services. You must have legal authority to enter into this agreement and purchase the selected services.
3. Accounts and Security
You must provide accurate, current information and keep it updated. You are responsible for all activity through your account and for protecting passwords, email accounts, Discord accounts, API keys, bot tokens, SSH keys, and other credentials.
Notify us promptly if you suspect unauthorized access. We may require identity or account verification before changing ownership, billing, or security information. Accounts may not be sold, transferred, or shared in a manner that creates security or abuse risks without our permission.
4. Services and Provisioning
Service features, resource limits, billing periods, stock, and prices are shown in the billing portal when an order is placed. Provisioning is usually automatic after successful payment and fraud checks, but activation times are not guaranteed.
We may add, remove, replace, or modify features when reasonably necessary for security, reliability, legal compliance, supplier changes, or service improvement. Material changes to an active paid service will be communicated when practical.
5. Orders, Prices, and Payments
You agree to pay the prices, billing intervals, and applicable charges shown during checkout. Payments are processed through available third-party payment providers, currently including Stripe. We do not intentionally store complete payment-card numbers or card security codes.
Prices are displayed in the currency shown during checkout. Customers are responsible for fees imposed by their bank, card issuer, currency provider, or payment service. We may correct obvious pricing or billing errors and will offer an appropriate remedy where payment has already occurred.
6. Renewals and Cancellation
Recurring services renew for successive billing periods until cancelled. Depending on the selected payment method and authorization, payment may be charged automatically or an invoice may require manual payment.
You may cancel through the billing portal. Cancellation normally prevents the next renewal and does not automatically refund the current billing period. Unless immediate termination is requested or required, a prepaid service may remain available until the end of its paid term.
Refund eligibility is governed by our Refund Policy, including the seven-day window for an eligible initial purchase.
7. Overdue Invoices, Suspension, and Deletion
Invoices must be paid by their stated due date. A service may be suspended when an invoice is two days overdue. Access may remain restricted until all required amounts are paid and the service is restored.
A service and its associated data may be permanently deleted when an invoice is fourteen days overdue. Pending unpaid orders may also be cancelled. These timeframes describe our normal automation and do not guarantee that data will remain available for the entire period.
You remain responsible for maintaining independent backups and paying valid charges incurred before suspension, cancellation, or termination.
8. Acceptable Use
You must comply with our Acceptable Use Policy and applicable law. Prohibited activities include spam, malware, credential theft, phishing, fraud, unauthorized access, attacks, resource abuse, infringement, and unlawful content or conduct.
We may investigate suspected abuse, restrict network traffic, preserve evidence, suspend services, remove content, or terminate accounts when reasonably necessary to protect the platform, customers, third parties, or our providers.
9. Customer Content
You retain ownership of content you lawfully upload. You grant Paradise Hosting a limited permission to host, copy, transmit, back up, inspect, or otherwise process that content only as reasonably necessary to provide support, operate and secure the services, investigate abuse, enforce our agreements, or comply with law.
You represent that you have the rights and permissions necessary for your content and that it does not violate law, these Terms, or another person’s rights.
10. Resource Limits and Fair Use
You must remain within the memory, CPU, disk, network, allocation, database, backup, and other limits assigned to your plan. You may not evade limits, interfere with neighboring services, or use a plan in a way that threatens stability or security.
We may throttle, stop, suspend, or require an upgrade for sustained excessive use, attempts to bypass limits, or activity that harms the platform.
11. Backups and Data Loss
Any backup feature is provided as a convenience and is not a guarantee against data loss. Backups may be incomplete, unavailable, corrupted, delayed, or removed under retention and capacity limits.
You are responsible for keeping current, independent copies of important files, databases, configurations, encryption keys, and code outside Paradise Hosting. We are not a permanent archival service.
12. Support
Support is provided through the billing ticket system and available Discord integration. Response times are estimates unless a written service-level agreement explicitly states otherwise. Support does not include writing, debugging, or maintaining customer code unless separately agreed.
Never send passwords, full payment-card details, private keys, API secrets, or bot tokens through ordinary tickets, email, or Discord messages.
13. Availability and Maintenance
We work to provide reliable service but do not guarantee uninterrupted or error-free operation unless a specific written service-level agreement says otherwise. Maintenance, upgrades, attacks, supplier failures, software defects, network events, emergencies, and circumstances outside our reasonable control may affect availability.
We may perform emergency maintenance without advance notice. Planned maintenance may be announced when practical.
14. Third-Party Services and Software
The services may depend on third parties such as Stripe, Discord, network providers, data centers, operating systems, control panels, and open-source software. Their terms and availability may also apply. We are not responsible for third-party services outside our reasonable control.
15. Intellectual Property and Complaints
Paradise Hosting branding, website materials, and original platform content may not be copied or misrepresented without permission. If you believe hosted content infringes your rights, send a detailed notice to support@paradisehosting.xyz. We may request additional information necessary to evaluate the report.
16. Suspension and Termination
We may suspend or terminate an account or service for nonpayment, fraud, security risk, abuse, legal requirements, provider demands, repeated violations, or material breach of these Terms. Immediate action may be taken where delay could cause harm.
Upon termination, access may end immediately and associated data may be permanently deleted. Sections intended by their nature to survive termination—including payment obligations, disclaimers, liability limits, and dispute provisions—will survive.
17. Disclaimer of Warranties
To the maximum extent permitted by law, the services are provided "as is" and "as available." Paradise Hosting disclaims implied warranties, including merchantability, fitness for a particular purpose, noninfringement, and warranties arising from course of dealing or usage of trade.
We do not warrant that the services will be uninterrupted, error-free, completely secure, compatible with every application, or immune from data loss. Nothing in these Terms excludes a warranty or right that applicable law does not allow to be excluded.
18. Limitation of Liability
To the maximum extent permitted by law, Paradise Hosting will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, revenue, business, goodwill, or opportunities; or loss, corruption, or disclosure of data arising from the services.
To the maximum extent permitted by law, our total liability arising from a particular service or event will not exceed the amount you paid Paradise Hosting for the affected service during the three months immediately preceding the event giving rise to the claim. This limitation does not apply where liability cannot legally be limited.
19. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold Paradise Hosting harmless from third-party claims, damages, losses, and reasonable costs arising from your hosted content, your misuse of the services, your violation of law, or your breach of these Terms or another person’s rights.
20. Governing Law and Disputes
These Terms are governed by the laws of the State of New York and applicable United States federal law, without regard to conflict-of-law principles. Unless applicable law requires otherwise, disputes will be brought in a court of competent jurisdiction located in New York.
Before filing a claim, you agree to contact us and make a good-faith effort to resolve the dispute informally. This does not prevent either party from seeking urgent relief or exercising rights that cannot be waived.
21. Changes to These Terms
We may update these Terms as our services, risks, suppliers, or legal obligations change. Revised Terms will be posted here with a new effective date. Material changes may also be communicated through the billing portal or email. Continued use after the effective date constitutes acceptance where permitted by law.
22. General Provisions
If a provision is found unenforceable, it will be modified or removed only to the minimum extent necessary, and the remaining provisions will continue. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them in connection with a transfer of the business or services.
